Time, teleworking and digital disconnection: a reflection from the reform on teleworking in Mexico

Resumen
The reform of the Federal Labor Law of 2021, that established teleworking as a legal regime, has been insufficiently discussed, so this article aims to debate the potential of teleworking to combat some problems strictly related to the way in which that energizes work in our country. For this reason, what is proposed is to glimpse how this modality can be a tool that helps some workers (with peculiar working and living conditions) to face the control that they have over their time in contemporary times. To achieve the above, different worldwide legislations that regulate teleworking have been reviewed, with the aim of shedding light on the possibilities that Mexican law has and can achieve to expand its field of exercise. Thus, we discuss the possibility of legislation that grants the right to certain labor workers under this condition, and we talk about the risks involved in promoting teleworking as a new form of employment, such as hyperconnectivity. For this reason, we also reflect on the right to disconnect and the need for the Mexican State to open a serious debate on the use of ICTs in working life
