Resumen
The present investigation focuses on a topic of the greatest importance for Constitutional Justice and that is to analyze if it is viable that unconstitutional or unconventional constitutional reforms can exist in our country and consequently declare their invalidity, the above was derived of a impugnment via actions of unconstitutionality against a reform that increased the legal assumptions of origin of the mandatory preventive prison. The rapporteur minister presented a draft sentence that proposed not applying the second paragraph of article 19 of the Constitution that contemplates the aforementioned precautionary measure, which gave rise to the discussion of the feasibility of declaring its invalidity. Finally, the project was withdrawn by the majority opposition to its determination; However, said project initiated a discussion that is actually a milestone for the Mexican State and that is the possibility of declaring a constitutional norm invalid because it violates the Constitution or international deals.
