The free will to end the matrimonial bond as a manifestation of the first constitutional article in Mexico

Resumen
The annulment of the matrimonial bond has always been subject of debate from social and juridical perspectives, as is the State’s obligation to protect the family’s stability, but, this can’t be achieved by imposing restrictions to personal liberties. In this work we will present an historic abridgment of divorce on Mexican law, followed by a scrutiny of current legal ways in Mexico to dissolve the matrimonial bond, making emphasis on non-causal divorce, a legal tool that has its juridical basis on the human rights established in our Constitution. We conclude that, a judge’s requirement to prove a cause or need for ruling a divorce is unconstitutional, due to the fact that this transgresses the human right to free development: a unilateral manifestation of will to end the marriage and a solution to all other important family issues, like child custody, is enough to decree the annulment of any matrimonial bond.
