The executive secretariats of Mexico’s anti-corruption systems. Legal nature and its effects on the control of corruption

Resumen
In 2015 the National Anticorruption System was created in the Mexican Constitution. Several works have analyzed its novel design, which places citizen participation in the spotlight, as well as the challenges the system faces. However, little has been written about the system’s Executive Secretariat or the similar executive secretariats of the anticorruption systems at the state level. This paper analyzes the legal nature of these executive secretariats focusing on their atypical characterization as descentralized public agency that the legislation established and the consequences for their internal management and the effectiveness of their work. The paper does not analyze all the institutions that make up the anticorruption systems, but it highlights the relationship they keep with their local anticorruption systems and their interactions with other public entities. The paper concludes that the legal configuration of the executive secretariats produces several problems and effects that jeopardize the achievement of their intended goals and objectives.
