Resumen
This is descriptive-explanatory research, with a qualitative approach, on the recognition of nature as a subject of rights in the 2008 Constitution of the Republic of Ecuador, an innovative milestone for the theory of law from the perspective of authors such as Zaffaroni, Ávila Santamaría, Melo and Gudynas. This recognition presents challenges in its materiality. Methodologically, research methods were used; qualitative, as well as methods proper to legal research such as the hermeneutic method. The goaled research is to carry out a doctrinal analysis on the theoretical compilation on the way in which the rights of nature have been developed in the international context and in the specific Ecuadorian case. The hypothesis presented is the necessary adoption of the biocentric paradigm for the protection of nature in Ecuador and so the legislative need to develop mechanisms for its protection.
