Resumen
The objective of the research is to analyze workplace harassment in Ecuadorian law, without prejudice to a review of international regulations, as well as doctrine. The methodology applied is that of an investigation under the qualitative, documentary and descriptive approach, carrying out a content analysis based on regulations, doctrine and other documents. As a result, it is observed that workplace harassment is a reality worldwide that has attracted the attention of different States that have incorporated into their legislation regulations in this regard, there are even various international instruments that support the need to incorporate policies and prevent this reality, from which the criminal plane does not escape,since there are paradigmatic examples such as the case of Spain and Colombia. There is still a long way to go in the matter, at the labor level, and even in the delimitation of the type in the criminal field, highlighting that in Ecuador there is no specific figure to regulate conduct in criminal proceedings. It is an original study, since there is little doctrinal development in Ecuador of this figure, there is a small number of specialized works on the subject.
