Resumen
Updating and harmonizing cooperative legislation in the Latin American region continues to be an unfinished task demanded by the cooperative sector; and although there are regional efforts that have met this demand, the new trends and needs of the sector at the national and regional levels make it essential to resume these efforts. In order to carry out such work, a survey of domestic legislations is required. Although they are heterogeneous, from comparative law, it is possible to identify common aspects and trend lines that contribute to the unifying effort, without altering the context or endogenous factors that characterize the Social and Solidarity Economy and in which the cooperative is located as an associative figure par excellence. Therefore, this work studies, through the comparative method and with the application of the documentary technique, the cooperative legislation in Mexico and Brazil, both countries with a recognized trajectory in the field of cooperativism. The results obtained allow us to conclude that there are certain legal elements of both legal systems that can be rescued in order to contemplate and reflect on them in a regional harmonizing effort.
