Resumen
In recent decades, care work has been recognized at both international and regional levels as a universal human right, extending beyond traditional gender roles. To effectively realize this right, formal recognition in law is insufficient; proactive measures by the State are essential. The concept of the State’s role in this regard has evolved over time, moving from a classical liberal stance of minimal intervention to one of positive and effective action. Recent legal advancements refer to this key concept as the “diligent State” an entity committed to upholding the highest standards for the realization and effectiveness of human rights, particularly in care work. The aim of this study is to examine, through a bibliographic review, the meaning and conceptual scope of the State from a diligent perspective as a framework for maximizing the realization of care. Methodologically, this study follows a qualitative approach, applying a documentary design. It concludes that the role of the diligent State is pivotal in creating safeguards through a new human rights approach, involving the establishment and adaptation of norms and public policies to ensure concrete, measurable, and evaluable outcomes.
